Indemnity Form for Aura8 Retreat
I hereby declare that I am sufficiently fit physically and participating voluntarily in the Aura8 Retreat (“Event”) to be conducted by Foundrynco Pte. Ltd. (“Company”) in St. Moritz during the period of the Event, on dates as notified by the Company prior to commencement, and that I do not have any medical concerns or conditions which could preclude me from taking part in any activities during the Event.
Assumption of Risk
1. I am aware that the Event will include sessions of mindfulness/meditation, group discussion (with a psychological exploration of self/family of origin/relationships, beliefs & mindsets, unhelpful behaviour patterns etc), live coaching & role play, some movement/dance/yoga, self-reflection & journalling, closed eye visualisation, as well as contemplation of past/present/future ideal life / challenges and may also involve strenuous physical activities.
2. I affirm and acknowledge that I have been fully informed of the inherent risks associated with the activities during the Event which may include but is not limited to: (a) my awareness to bodily sensations, thoughts, and feelings, including those that may feel familiar/comfortable and those that may feel unfamiliar/uncomfortable during the practice of meditation/mindfulness; and (b) the possibility of experiencing intense and unusual psychological, spiritual, and/or physical states of mind and body.
3. I declare that I am fully aware of and agree to assume any and all risks involved which might be associated with this Event.
Release of Liability, Waiver of Claims, and Indemnity Agreement
4. In consideration for being permitted to participate in the Event, I:
(a) undertake to comply with all applicable policies, rules, regulations, guidelines, reasonable directions put in place by the Company as well as the management of the Premises, which I acknowledge are in place for my safety and well-being; and agree to indemnify, absolve and discharge the Company from all claims, losses, injuries or damage whatsoever caused by or sustained as a result of my breach of this undertaking;
(b) hereby release, waive and discharge the Company and their directors, officers, agents, servants and employees from, and covenant not to sue the Company and their directors, officers, agents, servants and employees for, any and all liability, claims, demands, actions and causes of action whatsoever arising out of or in relation to any loss, damage or injury including death, that may be sustained by me or to any property owned by me as a result of my participation in the Event and related activities; howsoever caused; and
(c) further agree to indemnify and hold harmless the Company from any losses, claims, damages, liabilities, costs and expenses (including legal fees) that they may suffer or incur arising out of or in relation to, directly or indirectly, my presence and/or behaviour during the Event and whether caused by the negligence of the Company or otherwise, to the extent permitted by law.
5. I further expressly agree that the foregoing release, waiver, discharge, covenant and indemnity agreement is intended to be as broad and inclusive as permitted by law and that if any portion thereof is held invalid, it is agreed that the remainder shall continue in full force and effect.
Personal Data Consent
6. I give consent to the Company to collect, use, disclose and/or process my personal data or personal information I have provided for the purposes of administering my participation in the Event and activities and agree that my personal data may/will be disclosed to the Company’s third-party service providers, which may be based outside of Singapore. I also consent to the Company, collecting my personal data from the Event for the same purposes. I agree to the Company sending to me marketing, advertising and promotional information for this Event and other future events, and I understand that I may opt out of receiving such marketing, advertising and promotional information at any time by notifying the Company.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY ACKNOWLEDGING IT, AND I ACKNOWLEDGE IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
